Terms Of Use

ZP1.com has rules and policies that users must follow when posting items on the site.

The following activities are prohibited on ZP1.com
  • Posting an ad in states or provinces other than the one in which you live
  • Posting an ad in cities other than the one in which you live
  • Posting the same ad several times
  • Posting an ad that sends traffic to another Web site
  • Posting a "hate speech"
  • Posting a multi-level marketing or other prohibited job
  • Posting pornography, nudity or other prohibited personal ads
  • Posting an ad for items you do not own
  • Posting an ad with unrealistic prices
Prohibited items:
  • alcoholic beverages
  • blood, bodily fluids and body parts
  • burglary tools
  • counterfeit currency, stamps or coins
  • counterfeit products
  • electronic surveillance equipment
  • embargoed goods
  • escort or accompanying services
  • government and transit uniforms, IDs and licenses
  • illegal drugs & drug paraphernalia
  • illegal services
  • hazardous materials
  • fireworks, destructive devices and explosives
  • identity documents, personal financial records and personal information (in any form, including mailing lists)
  • items which encourage or facilitate illegal activity
  • lottery tickets, sweepstake entries and slot machines
  • Massage services
  • Obscene Material and Child Pornography
  • Offensive Material
  • pyramid schemes
  • Pictures or images that contain nudity
  • Police Badges and Uniforms
  • Prescription Drugs and Devices
  • Prostitution or ads that offer sex, sexual favours or sexual actions in exchange for money
  • Recalled items
  • Satellite products that violate the Radiocommunication Act
  • Sexual services, including camming
  • Solicitation of other users except by placing an Ad
  • Stolen Property
  • Tobacco Products
  • Used Cosmetics
  • Weapons and related items (such as firearms, firearm parts and magazines, ammunition, BB and pellet guns, tear gas, stun guns, switchblade knives, and martial arts weapons)
  • Pets

The following types of Pet ads are prohibited on the site:
  • The Animal Pedigree Act makes it a federal offence to sell an animal of a recognized breed as purebred, registered or eligible to be registered if it is not.
  • Any Ad that violates the Animal Pedigree Act will be reported to the police and will face criminal charges. ZP1.com monitors the .pets. activity with extra care.
  • ZP1.com is a strong supporter of animal rights.
  • Jobs
  • Business or job opportunities that require upfront or periodic payments
  • Business or job opportunities that pay only commissions, unless the Ad makes it clear that the sole source of compensation would be commission and clearly describes the product or service that would be sold
  • Business or job opportunities that require recruitment of other members, distributors or agents
  • Ads that are not clear regarding what type of work would be required

The following types of Personal or Erotic Service ads are prohibited on the site:
  • Ads that contain pornographic or individuals engaging in sexual activities
  • Ads that ask for sex from under age persons
  • Ads that offer sex or sexual activities in exchange for money, products or services
  • Ads that depicts a person(s), regardless of gender, engaged in actual sexual conduct
  • Ads that contain bestiality
  • Ads that contain masturbation
  • Ads that contain sadistic or masochistic abuse
  • Ads posted by Men in the "Women seeking Women" category
  • Ads posted by Men in the "Women seeking Men" category
  • Ads posted by Women in the "Men seeking Men" category
  • Ads posted by Women in the "Men seeking Women" category
Upgrading your listings Terms of use and Refunds:
ZP1.com does provide a refund for Advertising Fee according to the guidelines outlined below, and is committed to working with you to provide our customers with a 100% customer satisfaction guarantee.
  1. As a member of ZP1.com, you must provide a written explanation to the purpose of your refund by e-mail. Contact us
  2. Members must make a claim for a refund claim within 15 days of the original purchase. There are no refunds after 15 days of the original purchase, however, a user can terminate their membership at any time according to the User Agreement.
  3. If ZP1.com has a listing error or does not provide the service you were promised ZP1.com would refund your money no questions asked.
  4. Free memberships do not qualify for a refund.
  5. We have the right to remove anyones Ad if you do not follow the rules of the website.
VIOLATION OF TERMS AND LIQUIDATED DAMAGES
Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

You understand and agree that, because damages are often difficult to quantify, if it becomes necessary for ZP1 to pursue legal action to enforce these terms, you will be liable to pay ZP1 the following amounts as liquidated damages, which you accept as reasonable estimates of ZP1s' damages for the specified breaches of these Terms:

a. If you post a message that
  1. impersonates any person or entity;
  2. falsely states or otherwise misrepresents your affiliation with a person or entity;
  3. that includes personal or identifying information about another person without that person's explicit consent, you agree to pay ZP1 one thousand dollars ($1,000) for each such message. This provision does not apply to Content that constitutes lawful non-deceptive parody of public figures.
b. If ZP1 establishes limits on the frequency with which you may access the Service, or terminates your access to or use of the Service, you agree to pay ZP1 one hundred dollars ($100) for each message posted in excess of such limits or for each day on which you access ZP1 in excess of such limits, whichever is higher.

c. If you send unsolicited email advertisements to ZP1 email addresses or through ZP1 computer systems, you agree to pay ZP1 twenty five dollars ($25) for each such email.

d. If you post Content in violation of the terms other than as described above, you agree to pay ZP1 one hundred dollars ($100) for each Item of Content posted. In its sole discretion, ZP1 may elect to issue a warning before assessing damages.

e. If you are a Posting Agent that uses the Service in violation of the TOU, in addition to any liquidated damages under clause (d), you agree to pay ZP1 one hundred dollars ($100) for each and every Item you post in violation of the terms. A Posting Agent will also be deemed an agent of the party engaging the Posting Agent to access the Service (the "Principal"), and the Principal (by engaging the Posting Agent in violation of the terms) agrees to pay ZP1 an additional one hundred dollars ($100) for each Item posted by the Posting Agent on behalf of the Principal in violation of the terms.

f. If you aggregate, display, copy, duplicate, reproduce, or otherwise exploit for any purpose any Content (except for your own Content) in violation of these Terms without ZP1's express written permission, you agree to pay ZP1 three thousand dollars ($3,000) for each day on which you engage in such conduct.

Otherwise, you agree to pay ZP1's actual damages, to the extent such actual damages can be reasonably calculated. Notwithstanding any other provision of these Terms, ZP1 retains the right to seek the remedy of specific performance of any term contained in these Terms, or a preliminary or permanent injunction against the breach of any such term or in aid of the exercise of any power granted in these Terms, or any combination thereof.

DISCLAIMER OF WARRANTIES

YOU AGREE THAT USE OF THE ZP1 SITE AND THE SERVICE IS ENTIRELY AT YOUR OWN RISK. THE ZP1 SITE AND THE SERVICE ARE PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, ZP1 DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE ZP1 SITE AND THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, ZP1 DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE ZP1 SITE OR THE SITES OR SERVICE, OR ACCESSED THROUGH ANY LINKS ON THE ZP1 SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, ZP1 DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE ZP1 SITE OR THE SERVICE.

PROPRIETARY RIGHTS

The Service is protected to the maximum extent permitted by copyright laws and international treaties. Content displayed on or through the Service is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws, and international conventions. Any reproduction, modification, creation of derivative works from or redistribution of the site or the collective work, and/or copying or reproducing the sites or any portion thereof to any other server or location for further reproduction or redistribution is prohibited without the express written consent of ZP1. You further agree not to reproduce, duplicate or copy Content from the Service without the express written consent of ZP1, and agree to abide by any and all copyright notices displayed on the Service. You may not decompile or disassemble, reverse engineer or otherwise attempt to discover any source code contained in the Service. Without limiting the foregoing, you agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any aspect of the Service. ZP1 is a registered mark in the U.S. Patent and Trademark Office.

Although ZP1 does not claim ownership of content that its users post, by posting Content to any public area of the Service, you automatically grant, and you represent and warrant that you have the right to grant, to ZP1 an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute said Content and to prepare derivative works of, or incorporate into other works, said Content, and to grant and authorize sublicenses (through multiple tiers) of the foregoing. Furthermore, by posting Content to any public area of the Service, you automatically grant ZP1 all rights necessary to prohibit any subsequent aggregation, display, copying, duplication, reproduction, or exploitation of the Content on the Service by any party for any purpose.
